GIA ON-LINE TERMS AND CONDITIONS

  • You can use GIA On-line to access nominated Accounts. Please read these terms and conditions carefully as they govern your use of GIA On-line.
  • These terms and conditions may be varied at any time. Such changes will be notified to you on our website on or before the day those changes take effect. Therefore you should check this website regularly.
  • For queries concerning GIA On-line contact us on 1800 636 134 (Freecall).
  • If you believe that your Password has become known to anyone other than yourself, please refer to clause 7 for the action to take to limit your liability.
  • The meaning of defined terms in these terms and conditions is explained in clause 15 below.
1. Terms and Conditions

Your use of GIA On-line is governed by these terms and conditions which are to be read together with the Account Conditions. Where there is any inconsistency between these terms and conditions and the Account Conditions, the latter will prevail.

2. Registering

2.1 You agree to these terms and conditions when you first use GIA On-line.

2.2 You may apply for access to GIA On-line by completing and returning to us the registration form. A copy of the form can be obtained by phoning 1800 636 134 (Freecall) on Sydney business days between 8:30am and 4:30pm AEST or visiting our website. Click on 'Forms' on the left menu-bar. Approval of your application is at our discretion.

2.3 When we register you for GIA On-line we give you a Password. You must change this Password when you first use GIA On-line. You can change your Password at any other time you use GIA On-line. Refer to clauses 6 and 7 regarding the security of your Password.

3. Using GIA On-line

3.1 You must enter both your Login Name and Password to access GIA On-line. Access to GIA On-line will be denied if the Login Name and Password are incorrectly entered 3 times. If this occurs you can contact us on 1800 636 134 (Freecall) on business days between 8:30am and 4:30pm, Sydney time to request a new Password.

3.2 You can use GIA On-line to initiate Website Transactions on nominated Accounts, including, and depending on the Account, funds transfers, ordering cheque books, downloading data in relation to the Account, cancelling cheques and obtaining Account statements. We reserve the right to add, remove, change or impose restrictions on, the functionalities of GIA On-line at any time.

3.3 We may cancel your access to GIA On-line at any time without notice. We may refuse to give effect to any Website Transaction without being required to give any reason or advance notice to you.

3.4 If you are seeking access to an Account which requires two or more persons to sign, then access to debit that Account will only be available if the required number of authorised persons have each entered their Login Name and Password.

The creation of payments and the authorising of payments can be made separately by the required number of signatories, on their own machines and at a time convenient to themselves.

3.5 It is your responsibility to obtain and maintain any equipment (for example, a personal computer) or Account with an appropriate internet or online service provider which you may need for your use of GIA On-line.

3.6 We apply a $10,000 limit per Account on the sum of all Website Transactions on any one day on that Account. This limit may be increased on written application.

4. Transaction processing

4.1 We are entitled to assume that any access and operation of GIA On-line using your Password and Login Name has been made by you or a person authorised by you, unless we have notice to the contrary. Our records will be prima facie evidence of such access and operation.

4.2 We issue an electronic receipt for a Website Transaction at the time of the transaction. However, we reserve the right to assign any date we consider appropriate to debits and credits on Accounts.

4.3 All Website Transactions will be recorded in the regular statements for your nominated Account provided in accordance with the Account Conditions. You should check these statements regularly and notify us of any discrepancies, omissions, debits wrongly made, inaccuracies or incorrect entries.

5. What we will do

5.1 We will make reasonable efforts to:
(a) ensure that GIA On-line is available during the hours specified by us from time to time, and
(b) ensure that information we make available to you through GIA On-line is correct.

5.2 Some services may not be available at all times. If a facility or service is not available, you are responsible for making alternative arrangements to conduct your business with us. We will make every effort to inform you of any scheduled maintenance by placing a notice on our home page.

5.3 Information available through GIA On-line concerning transactions and balances on an Account may not always be completely up to date, although in most cases should at least reflect the transactions and balances of an Account up to the close of business on the previous business day.

6. Security

6.1 The security of your Password is very important as it is comparable to your signature on a cheque or a withdrawal form. You must make every effort to ensure that your Password, and any record of it, is not misused, lost or stolen.

6.2 You must:
(a) change the Password we initially allocate to you when you first use GIA On-line
(b) not record your Password or Login Name on the computer that you use to access GIA On-line
(c) not record your Password on any item that identifies your Login Name or on any article normally carried with any such item and which is liable to loss or theft with that item
(d) not permit any other person to use your Password or Login Name
(e) not disclose your Password or Login Name or make it available to any other person (including a family member, another signatory to the Account, a friend or one of our staff)
(f) use care to prevent anyone else seeing your Password and Login Name being entered into any computer.
(g) choose a Password that is not identifiable with anything about you, and
(h) change your Password from time to time.

7. Breach of security

7.1 You must tell us as soon as possible if you suspect that your Password or Login Name is known to someone else or you suspect any unauthorised use of it. You may notify us by telephoning us on 1800 636 134 (Freecall) leaving a message if calling after hours.

7.2 If you do not notify us you may be liable for unauthorised use - see clause 8.

7.3 You will need to give us all relevant information you may have, so that we can suspend GIA On-line access to the nominated Accounts. You must confirm in writing any notice you give us by telephone.

7.4 If you are unable to notify us (under clause 7.1) because our telephone service is unavailable you are not liable for any unauthorised transaction which could have been prevented if you had been able to tell us. However, you must make reasonable efforts to contact us by alternate means and must tell us within a reasonable time after our telephone service becomes available again.

7.5 We may cease to provide GIA On-line at any time if we have reasonable grounds to believe that there has been a security breach.

8. Liability

8.1 You should not interpret anything in these terms and conditions as modifying any term or condition which is implied by consumer protection legislation.

8.2 Except for the terms and conditions which are implied by consumer protection legislation, we:
(a) make no express or implied warranty or representation in connection with GIA On-line (including with respect to type, quality, standard or fitness for any purpose)
(b) are not liable for any loss you suffer (including consequential loss) arising in connection with GIA On-line, and
(c) are not liable for any loss you suffer (including consequential loss) in connection with our negligence or our breaching a term, warranty or condition in relation to GIA On-line.

8.3 Where we are liable for a breach of these terms and conditions (which include implied terms and conditions), then our liability will exclude, to the maximum extent permitted by law, any indirect or consequential loss you may suffer and is limited to:
(a) the supply of the service again, or
(b) payment of the cost of having the service supplied again, or
(c) AUD $5,000 where our liability results from a breach of these terms and conditions, other than a breach of implied terms and conditions.

8.4 Our failure to enforce a term of these terms and conditions does not mean we waive that term.

9. Indemnity

You indemnify us against any loss we suffer because we:
(a) act on an instruction made via GIA On-line using your Password and Login Name, whether or not the instruction is authorised by you, or
(b) fail to act or fail to act immediately on any instruction for any reason.

You indemnify us against any loss we suffer because you breach these terms and conditions or act negligently or fraudulently in relation to GIA On-line.

10. Fees or charges

10.1 Currently we do not charge any service charges or transaction fees for using GIA On-line. However, you remain liable to pay any fees and charges payable to us in accordance with the Account Conditions of your Account.

10.2 We may at any time impose and vary fees and charges for the use of or arising from the use of GIA On-line and you must pay us such fees.

11. Notices

All notices and other communications which concern GIA On-line will be in writing. We may give you a notice either by:
(a) prepaid post to the address last notified
(b) personally serving the notice at the address last notified
(c) broadcasting a message via GIA On-line
(d) delivering it to you by an electronic message to your latest email address recorded
(e) making press advertisements in Australian newspapers of general circulation, or
(f) transmitting the notice to the last notified facsimile number.

12. Problems, errors and complaints

If you believe an error has been made, please notify us by phoning 1800 636 134 (Freecall) on Sydney business days 9am to 5pm, AEST.

13. Privacy

13.1 We are bound by the National Privacy Principles set out in the Privacy Act 1988 (Cth). Information about our approach to privacy can be obtained from our website or by contacting our privacy compliance officer on (02) 9265 1686 or at privacy@glebegroup.com.au.

13.2 You acknowledge that we use third parties to operate the technical platform for the website from which GIA On-line is accessed. They may have access to personal information about you during the course of providing the platform. They will hold all your personal information in strictest confidence and will not use or disclose it for any other purpose.

14. General

14.1 You or we may end this agreement at any time by giving notice to the other party. If you terminate this agreement you must cease using GIA On-line immediately.

14.2 These terms and conditions are governed by and construed in accordance with the laws of the State of New South Wales. You and we irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of New South Wales and courts of appeal from them.

14.3 You may not assign your rights or obligations under these terms and conditions.

14.4 We may assign or novate our rights and obligations under these terms and conditions.

15. Important Words

Account means a Glebe Income Account held with us from or to which you can transfer funds through GIA On-line by use of a Password.

Account Conditions means the terms and conditions applicable to the Account set out in the offer document issued by us from time to time for Glebe Income Accounts.

Login Name means the unique number issued to you by us to be used in conjunction with your Password to access GIA On-line.

GIA On-line means any service we offer from time to time through the Internet to enable you to receive information from us and to transmit instructions to us electronically, in relation to an Account or other matters we specify.

Password means the alpha numeric personal identification security code used in conjunction with your Login Name to access GIA On-line we, us and our means Glebe Administration Board.

Website Transaction means an instruction you give to us through GIA On-line using a Password and Login Name, including an instruction to debit or credit an Account, and

You means the Account holder and each person authorised by the Account holder from time to time to act on its behalf in respect of the Account.
